If you are a Standing Offer customer, refer to the following Standing Offer Customer Information. Small Market and Standing offer customers are all residential customers, and business customers who consume less than; 40Mwh p.a in Victoria, 100Mwh p.a in New South Wales, Queensland and the Australian Capital Territory; and 160Mwh p.a in South Australia. Business customers above this level are Large Market offer customers.
1. Cooling off period: All Market Offer Customers – You are entitled to a cooling off period of ten business days, from the date that you receive your welcome pack from us. You can exercise your cooling off rights by phone or by email. Cancellation of this contract after the cooling off period may result in early exit fees as disclosed below.
All Standing Offer Customers – Cooling off period does not apply. No exit fees apply.
2. Credit Check: This agreement is subject to a credit reference check. For information about how we may use and store your information you can view our Privacy Policy at www.nextbusinessenergy.com.au/privacy-policy
3. Terms and conditions: All Market and Standing Offer Customers – This Customer Agreement Form is subject to Next Business Energy’s Small Customer Terms and Conditions at www.nextbusinessenergy.com.au. This agreement, along with your welcome pack and our terms and conditions, constitute the contract between you and us (Next Business Energy).
4. Contract length: Non Victorian Small Market Offer and Large Market Offer Customers – The contract term for this arrangement is 24 months. At the end of this contract, your energy supply will continue on the same prices, terms and conditions, unless you tell us otherwise.
Victorian Small Market Offer Customers - there is no fixed term contract period for this arrangement and it does not expire. Please refer to our Market terms and conditions for information on when the contract ends at www.nextbusinessenergy.com.au
Standing Offer Customers – Standing Offer agreements do not expire. Please refer to our standard terms and conditions for information on when the contract ends at

5. Price variations: Non Victorian Small Market Offer and Large Market Offer Customers – Electricity charges may vary each year, in accordance with the terms and conditions of this contract. Price changes occur generally in July for New South Wales, Queensland, Australian Capital Territory and South Australian customers, but may occur other times. Price changes will be notified in writing.
Victorian Small Market Offer Customers - Price changes will occur 1 month after Distributor prices vary, the next price changes are anticipated in February 2021 and August 2021.
All Standing Offer Customers – If we vary our standing offer prices; we will publish the variation in accordance with applicable laws. We will also include details with your next bill if the variation affects you.
6. Security deposit: All Market and Standing Offer Customers – We may ask you to pay a security deposit in certain circumstances. Please see Next Business Energy’s small customer terms and conditions.
7. Electronic communications: All Market and Standing Offer Customers – In the event you agree to receive electronic communication, your bill and all other communication will be sent to the email address provided. You will be bound to, and have taken to have received, any and all information sent to you as part of that electronic transaction.
8. Invoicing: All Market and Standing Offer Customers – If you provide your consent to receive bills and other notices from us electronically, Next Business Energy will send invoices to the email address nominated in this Customer Agreement Form and will invoice you monthly where agreed.
SmoothPay invoices are based on agreed amounts for New South Wales with reconciliations every quarter or on an actual meter read.
9. Bank fees: All Market and Standing Offer Customers –
A merchant service charge of up to 2% may be charged on the total amount paid via credit card. This charge is added at the time of payment. Other bank fees, for example, dishonoured payment fees, will also be passed on where relevant.
10. Exit fees: All Market Offer Customers Only – Exit fees may apply for customers consuming more than 100 MWh per annum in New South Wales, Queensland, South Australia or the Australian Capital Territory, or more than 40 MWh per annum in Victoria. Exit fees are charged as our reasonable estimation of wholesale and other costs that we incur because of this contract being terminated, being $100 per MWh of usage, per month of the contract. If this agreement is cancelled within the first 12 months, three months’ worth of wholesale usage will be charged as an exit fee. If this agreement is cancelled within the second 12 months, one months’ worth of wholesale usage will be charged as an exit fee.
11. Additional Charges: All Market and Standing Offer Customers – All additional charges will be passed on at cost. Network charges can be referenced via your distributor’s website.
12. Victorian Small Market Offer Customers: You may request us to provide more information about the Victorian Default Offer and how you may access it.
13. Commencement: The agreement commences from the date that you sign and consent to this agreement. The rates and charges in this agreement are valid for 5 business days.
14. Commission: We may pay a commission, fee, or reward for the introduction of your business.
15. Metering Charges: You understand you may be charged an additional fee to cover the additional costs of advanced metering provided by a Meter Provider. For more information click here.

17. Complaints: All Market and Standing Offer Customers – We can be contacted for queries, complaints or disputes including in respect of any marketing activity conducted on our behalf. Any complaint will be handled in accordance with our standard complaints and dispute resolution procedures. If the response is not satisfactory, you have the right to refer the complaint or dispute to Energy Ombudsman in your state or territory.
